2. Who We Are

PE Property Buyers operates as a property acquisition and investment platform.

Property owners may submit properties to us for consideration as potential acquisition or investment opportunities. Where appropriate, information concerning a property may be presented to selected property buyers or investors whose acquisition criteria may suit the opportunity.

PE Property Buyers does not accept mandates to market properties on behalf of sellers and does not charge sellers commission for submitting a property or considering offers received through our process.

For purposes of POPIA, the person or entity determining the purpose and means of processing particular personal information will be the responsible party in respect of that processing.

  • information concerning arrears, foreclosure, sale in execution or other legal proceedings where relevant and disclosed to us;
  • company, close corporation, trust or other entity information where a property is held by or an investor operates through an entity;
  • investor experience, investment criteria and funding information;
  • correspondence and communications with PE Property Buyers;
  • information supplied in free-text fields or otherwise voluntarily communicated to us;
  • website usage and technical information such as IP address, browser type and device information; and
  • any other personal information reasonably necessary for the relevant enquiry, assessment, application or transaction.

We aim to collect only personal information reasonably necessary for the purposes for which it is processed.

 


4. Identification Information

PE Property Buyers may request a South African identity number, passport number, copy of an identity document or other identification information where reasonably necessary to:

  • verify a person’s identity;
  • confirm ownership of a property;
  • confirm a person’s authority to act in relation to a property;
  • assess or verify an investor application;
  • prepare or progress a proposed property transaction;
  • prevent fraud or misrepresentation;
  • provide information required by conveyancing attorneys or other authorised professionals; or
  • comply with applicable legal or regulatory requirements.

Identification information will not ordinarily be required merely to make an initial property enquiry and will generally only be requested when reasonably necessary for the relevant purpose or stage of the process.

Identification information will not ordinarily be included in a Property Opportunity Report or disclosed to potential buyers merely for the purpose of deciding whether they are interested in a property.

It may, however, be disclosed to conveyancing attorneys, financial institutions, professional advisers or other authorised parties where reasonably necessary to progress a transaction or comply with applicable law.

PE Property Buyers will take reasonable measures to protect identification information against unauthorised access, use or disclosure.

 


5. Property Information

As part of assessing a property as a potential acquisition or investment opportunity, PE Property Buyers may obtain information from:

  • the property owner or authorised representative;
  • an inspection of the property;
  • documents supplied to us;
  • lawful public records;
  • commercially available property information; and
  • other lawful sources.

Property information may include:

  • the property address and location;
  • ownership information;
  • property type;
  • accommodation;
  • improvements;
  • condition;
  • photographs;
  • plans where available;
  • approximate size or extent;
  • occupation;
  • leases;
  • relevant municipal or property information;
  • information relating to defects or repairs; and
  • other information reasonably relevant to evaluating the property as a potential acquisition or investment opportunity.

PE Property Buyers may use this information to prepare a Property Opportunity Report.

 


6. How We Use Personal Information

We may process personal information for purposes including:

  • responding to enquiries;
  • contacting you regarding a property you have submitted;
  • verifying your identity where reasonably necessary;
  • confirming ownership or authority in relation to a property;
  • conducting an initial desktop property assessment;
  • arranging and conducting a property inspection;
  • preparing a Property Opportunity Report;
  • assessing a property as a potential acquisition or investment opportunity;
  • identifying selected potential buyers whose acquisition criteria may suit the opportunity;
  • presenting relevant property information to selected potential buyers;
  • receiving and communicating expressions of interest or offers;
  • facilitating communications and the exchange of information necessary to progress a potential transaction;
  • completing or assisting with documentation relating to a proposed transaction;
  • assisting with administrative matters relating to an accepted transaction;
  • liaising with relevant attorneys or other professional service providers where appropriate;
  • processing applications to join our buyer network;
  • assessing prospective investors, their experience, funding ability and investment criteria;
  • administering relationships with approved members of the buyer network;
  • preventing fraud, misrepresentation and unlawful activity;
  • maintaining appropriate business and transaction records;
  • complying with legal and regulatory requirements;
  • managing disputes or potential legal claims;
  • improving our website, processes and services; and
  • protecting our legitimate business interests.

We will not knowingly process personal information for purposes incompatible with those for which it was collected unless permitted by law.

 


7. Sharing Property Information With Potential Buyers

An important part of the PE Property Buyers process may involve presenting suitable property opportunities to selected potential buyers.

By submitting a property to PE Property Buyers, you acknowledge that information reasonably necessary to evaluate the property may be shared with selected property buyers or investors.

This may include:

  • property address or location;
  • photographs;
  • accommodation and property details;
  • property condition;
  • relevant improvements;
  • plans where available;
  • occupation information;
  • relevant lease information;
  • expected or proposed selling price where applicable;
  • relevant information concerning the circumstances of the property where reasonably necessary; and
  • other property information reasonably required to evaluate the opportunity.

We will not provide potential buyers with more personal information about a property owner than is reasonably necessary for evaluating or progressing a potential transaction.

In particular, identity numbers, copies of identity documents, bank account details and similar identification or financial information will not ordinarily be included in information circulated to potential buyers merely for the purpose of evaluating a property opportunity.

Where reasonably practical, unnecessary personal information identifying the property owner will be excluded from initial investment information.

 


8. Sharing Information With Other Parties

Where reasonably necessary for the relevant purpose, personal information may be shared with appropriate third parties including:

  • selected property buyers and investors;
  • conveyancing attorneys and other legal professionals;
  • financial institutions;
  • finance or bridging-finance providers where specifically relevant;
  • property professionals engaged for a specific purpose;
  • inspectors, contractors and other property-related service providers;
  • banks, creditors or their representatives where necessary and appropriately authorised;
  • website hosting, IT, email, telecommunications and communications service providers;
  • accountants and other professional advisers;
  • government departments, municipalities, regulators, courts, sheriffs or law-enforcement authorities where disclosure is required or permitted by law; and
  • other parties reasonably necessary to assess or progress a transaction.

Where another party processes personal information on our behalf as an operator, we will take reasonable steps to ensure that appropriate confidentiality and security arrangements apply as required by POPIA.

 


9. Investor Applications

Persons applying to join the PE Property Buyers buyer network may be asked to provide information including:

  • name and surname;
  • identity number or passport number where reasonably required;
  • contact details;
  • company, close corporation, trust or other investment-entity details;
  • company or entity registration number;
  • property investment experience;
  • number and types of properties owned or previously acquired;
  • preferred investment areas;
  • preferred property types;
  • typical purchase price range;
  • investment or acquisition strategy;
  • anticipated purchase volume;
  • funding method;
  • information regarding availability of cash or other funding;
  • proof of funds where reasonably required;
  • details of attorneys or other professional advisers where voluntarily supplied; and
  • other information reasonably necessary to assess the application.

This information may be used to verify the applicant and determine whether the applicant is suitable for inclusion in the PE Property Buyers buyer network.

Submitting an application does not guarantee admission to the network or access to property opportunities.

 


10. Legal Basis for Processing

PE Property Buyers will process personal information only where there is an appropriate basis for doing so under POPIA and applicable law.

Depending on the circumstances, processing may be necessary:

  • with your consent;
  • to take steps at your request before entering into a contract;
  • to perform obligations arising from a contract;
  • to comply with a legal obligation;
  • to protect a legitimate interest of the person concerned; or
  • to pursue the legitimate interests of PE Property Buyers or a third party, subject to applicable law.

Where processing is based specifically on consent, you may withdraw that consent, subject to any lawful processing that has already occurred and any other lawful basis that may continue to apply.

 


11. Direct Marketing

Submitting a property enquiry or investor application does not automatically constitute consent to receive unrelated marketing communications.

Where PE Property Buyers wishes to send electronic direct marketing requiring consent under POPIA, appropriate consent will be obtained.

Where permitted by law, existing customers or contacts may receive communications concerning similar products or services, subject to applicable requirements and the right to opt out.

You may withdraw marketing consent or unsubscribe from marketing communications at any time.

Communications reasonably necessary to:

  • respond to your enquiry;
  • arrange or conduct a property assessment;
  • communicate regarding a submitted property;
  • process an investor application;
  • administer an approved investor relationship; or
  • progress an existing or proposed transaction

are operational or service communications and are not treated as unrelated marketing communications.

 


12. WhatsApp, Email and Telephone Communications

Where you provide a telephone number, mobile number or email address, or select a preferred method of communication, PE Property Buyers may use that channel to communicate with you regarding your enquiry, property, investor application or transaction.

This may include communication by telephone, email, SMS or WhatsApp where appropriate.

Third-party communication providers may process information in accordance with their own terms and privacy policies.

Particular care will be taken with identification and financial information, including identity numbers, identity documents and bank information.

Access to personal information will, where reasonably possible, be limited to persons who require access for legitimate business purposes.

No electronic or internet-based system can be guaranteed to be completely secure. PE Property Buyers will nevertheless maintain reasonable safeguards appropriate to the nature of the information processed.

Where personal information is no longer reasonably required and there is no lawful reason to retain it, it will be deleted, destroyed or de-identified as appropriate.
